RECESSED MEETING

Gaines, NY         January 11,  2012

 

 

 

 

A Regular Town Board Meeting of the Town of Gaines, County of Orleans and the State of New York was held at the Gaines Town Hall, 14087 Ridge Road, Gaines, New York on the 10th day of January 2012 at 7:30 PM and recessed at 8:18 PM. The meeting reconvened on January 11, 2012 at 10:00 AM.

OTHERS PRESENT: Paul Chatfield, Chatfield Engineers

 

Supervisor Culhane called the meeting to order at 10:01AM with the Pledge to the Flag.

 

Paul Chatfield explained to the board that the contractor who had bid on the salt storage building, Shamrock Farm Fencing was requesting that the board accept his withdrawal of the contract because the poles he was planning to use for construction no longer meet the current building codes. It was the recommendation of the engineer that the board accepts his withdrawal.

 

RESOLUTION 23 - 12

ACCEPT WITHDRAWAL OF SALT STORAGE BUILDING CONTRACT

 

On a motion of Councilperson Kast, seconded by Councilperson Kirby  the following resolution was

 

ADOPTED    Ayes   4       Kast, Kirby, Culhane, Syck

Nays    0

 

Resolved that the contract from Shamrock Farm Fencing is withdrawn.

 

Paul Chatfield informed the board that Shamrock Farm Fencing was requesting that the bid security of $7245.00 that they had paid to the town be returned to them. Following a lengthy discussion on the bidding process and who had the responsibility of being sure that the bid was within building code regulations it was decided that the town would return only a portion of the money. The town feels that the responsibility was that of the engineers and of no fault of the town. It was determined that the town would incur $5100.00 in additional expenses to bid the construction of the salt storage building a second time. The town decided that they would keep $5100.00 from the bid security to cover the expenses.  At that time Chatfield engineers agreed to lower their expenses by $400.00 allowing those dollars to be returned to the bidder. The town agreed to return $2545.00 to Shamrock Farm Fencing.

 

 

 

RESOLUTION 24 - 12

RETURN BID SECURITY

On a motion of Councilperson Kast, seconded by Councilperson Kirby  the following resolution was

 

ADOPTED    Ayes   4       Kast, Kirby, Culhane, Syck

Nays    0

 

Resolved $2545.00 is returned to Shamrock Farm Fencing. If the expenses of bidding the Salt Storage Building are less than $4700.00 the difference will be retuned at a later date.

 

RESOLUTION 25 - 12

PERMISSION TO RE-BID SALT STORAGE BUILDING

 

On a motion of Councilperson Kast, seconded by Councilperson Syck  the following resolution was

 

ADOPTED    Ayes   4       Kast, Kirby, Culhane, Syck

Nays    0

 

Resolved that Chatfield Engineers has permission proceed to re-bid the salt storage building.

 

 

RESOLUTION  26 -12

MOTION TO RECESS

With no further business, on a motion from Councilperson Syck, seconded by Councilperson Kirby  the following resolution was

 

ADOPTED    Ayes   4       Kast, Kirby, Culhane, Syck

Nays    0

 

Resolved that the January 11, 2012  board meeting was adjourned at 10:45 AM.
